Sapakhana Affiliate Program Terms of Service

Welcome to the Sapakhana Affiliate Program! These Terms of Service (“Terms”) govern your participation in our affiliate program (“Program”). By joining the Program, you agree to abide by these Terms. If you do not agree to these Terms, please do not participate in the Program.

1. Enrollment

1.1 Eligibility: To become an affiliate, you must be at least 18 years old and have a valid website, blog, or social media presence that complies with our content guidelines.

1.2 Application: To apply, submit a complete application through our affiliate Signup (“Become an Affiliate). We reserve the right to accept or reject any application at our sole discretion.

2. Affiliate Responsibilities

2.1 Promotion: Affiliates are responsible for promoting Sapakhana’s products in a lawful and ethical manner. All promotional activities must comply with these Terms and applicable laws.

2.2 Content: All content used to promote Sapakhana’s products must be accurate and not misleading. Affiliates must clearly disclose their affiliate relationship with Sapakhana in accordance with Federal Trade Commission (FTC) guidelines.

2.3 Prohibited Activities: Affiliates may not engage in any of the following:

• Use of deceptive or misleading practices.
• Unauthorized use of Sapakhana’s trademarks, logos, or copyrighted materials.
• Spamming or sending unsolicited emails.
• Promoting Sapakhana’s products through illegal or unethical means.

3. Commission and Payments

3.1 Commission Structure: Affiliates earn 10-15% commission based on the sales generated through their unique affiliate links and Affiliates Rank. The commission rate and structure are outlined in the affiliate dashboard and may be subject to change.

3.2 Payment Schedule: Payments will be made on a monthly basis, provided the affiliate’s earned commissions meet or exceed the minimum payout threshold set by Sapakhana.

3.3 Refunds and Chargebacks: In the event of a refund or chargeback, the corresponding commission will be deducted from future payments or, if necessary, reclaimed from previous payments.

4. Intellectual Property

4.1 License: Upon acceptance into the Program, Sapakhana grants you a non-exclusive, revocable license to use its trademarks, logos, and other materials solely for the purpose of promoting Sapakhana’s products in accordance with these Terms.

4.2 Ownership: All intellectual property rights in Sapakhana’s trademarks, logos, and materials remain with Sapakhana. Affiliates may not use these assets in any way not expressly authorized by Sapakhana.

5. Termination

5.1 Termination by Affiliate: You may terminate your participation in the Program at any time by providing written notice to Sapakhana.

5.2 Termination by Sapakhana: Sapakhana reserves the right to terminate your participation in the Program at any time, with or without cause, including but not limited to violations of these Terms or illegal activities.

5.3 Effect of Termination: Upon termination, all rights to use Sapakhana’s intellectual property and access to the affiliate dashboard will cease. Any pending commissions will be paid in accordance with our standard payment schedule, subject to applicable deductions for refunds or chargebacks.

6. Limitation of Liability

6.1 Disclaimer: Sapakhana makes no warranties or representations regarding the Program, including but not limited to its uninterrupted availability or the accuracy of information provided.

6.2 Limitation of Liability: To the fullest extent permitted by law, Sapakhana shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your participation in the Program.

7. Governing Law

These Terms shall be governed by and construed in accordance with the digital marketing law without regard to its conflict of laws principles.

8. Modifications

Sapakhana reserves the right to modify these Terms at any time. Any changes will be communicated to affiliates through the affiliate dashboard or via email. Continued participation in the Program constitutes acceptance of the revised Terms.
